In a letter sent to the board of the National Telecommunications Commission on June 7, Sudharma Yoonaidharma said the NTC had full authority to examine the deals in their entirety. The NTC should not limit the probe by citing that some parts of the transaction were civil deals.
His letter recommended that the board examine how the deals could affect NTC measures of promoting fair competition and the regulations governing significant players in the market, mergers, and cross-shareholding.
Last month the NTC board announced that it would conduct a probe as allowed by its regulatory authority, including examining whether the CAT-True deals had breached the commission's measures governing wholesale and resale businesses.
Its other key focus is to review two parts of the deals to see if they contradict Article 46 of the Frequency Allocation Act. Article 46 requires licence holders to provide services on their spectra on their own, instead of allowing other parties to do if for them.
